AgTutors Terms of Use

Introduction

Welcome to AgTutors, a platform dedicated to connecting students and tutors at Texas A&M University. This website is owned and operated by Crouch Consolidated LLC DBA AgTutors. By accessing or using AgTutors, you agree to be bound by these terms and conditions (User Agreement) and our Privacy Policy. If you do not agree to these terms, do not use our services.

User Agreement

1. Student responsibility to screen and investigate background of Tutors

Ag Tutors merely brings together those people who are looking for a tutor and people who represent they are qualified to be a tutor. AgTutors does not investigate the background of the tutors. Only a TAMU email address is required to sign up to tutor on the site. No investigation of a tutor’s educational qualifications, knowledge or ability to tutor is conducted on a tutor by AgTutors. No criminal or civil background search is run on any tutor by AgTutors. No credit check is run on any tutor. It is the sole responsibility of the student to screen and investigate the background of the tutor(s) the student chooses to retain. AgTutors does not select a tutor for a student or determine the location for tutoring. A student solely chooses the tutor(s) and the student chooses the location for the tutoring and whether they wish to receive tutoring in zoom or in person. By using this site you accept and understand these terms and agree to them.

2. Location for Tutoring

All students and tutors agree that tutoring shall only be conducted via zoom or in public buildings on campus or in public buildings located off campus. No tutoring shall be done in dorm rooms, apartments, condos or houses.

3. Content Responsibility

AgTutors provides a platform for students and tutors to connect. We do not guarantee the accuracy, completeness, or usefulness of any information on the site and expressly disclaim liability for errors or omissions in this information. All content, including profiles, messages, and reviews, is the sole responsibility of the person from whom such content originated.

4. User Conduct

By using AgTutors, you agree not to post any content that is unlawful, harassing, defamatory, obscene, or that infringes on the rights of others. You are solely responsible for the content you publish, and AgTutors reserves the right to remove or edit content at our discretion and to terminate accounts for serious breaches.

5. Indemnification

In consideration for using this website and App, users agree to indemnify, defend and hold harmless AgTutors, its owners, officers, directors, employees, and agents from and against any claims, actions, demands, lawsuits, suits in tort and/or negligence, sole negligence, gross negligence, fraud, misrepresentation, criminal acts, contract, intentional acts, debts, liabilities, judgments, and settlements, including without limitation, reasonable attorney and legal fees arising out of or related to any use of our service, or your violation of the User Agreement. This indemnification includes but is not limited to any claims, actions, demands, lawsuits, suits in tort and/or negligence, sole negligence, gross negligence, fraud, misrepresentation, contract, intentional acts, criminal acts, liabilities, judgments, and settlements, including without limitation, reasonable attorney and legal fees arising out of or related to conduct by a “student” or “tutor” or third party or person using this website, App, tutoring, or other use of our service, and brought by any student or tutor, or any person claiming by or through any student or tutor against AgTutors, its owners, officers, directors, employees and agents.

6. Intellectual Property

All content on AgTutors, including text, graphics, logos, and images, is the property of AgTutors or its content suppliers and protected by international copyright laws.

7. User Content

By posting content on our platform, you grant AgTutors a non-exclusive, royalty-free license to use, reproduce, modify, and publish the content in connection with our services.

8. Account Security

Users are responsible for maintaining the confidentiality of their account information, including passwords. Any unauthorized use of your account should be reported immediately to AgTutors.

9. Modification of Terms

AgTutors reserves the right to modify these terms at any time. Continued use of the site after such changes indicates your acceptance of the new terms.

10. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our website, you consent to the data practices described in our Privacy Policy.

11. Posting Pictures and Links

To ensure our community remains welcoming and professional, we require all images shared on AgTutors to be work-safe. This means the following types of images are strictly prohibited:

  • Nudity or partial nudity
  • Pornographic or sexually explicit content
  • Any imagery deemed offensive or inappropriate for a general audience
All submissions contravening these guidelines will be removed immediately upon discovery. Users posting such content may face immediate suspension from the platform.

When including hyperlinks in your posts, ensure that the content on the linked site aligns with our community standards. Links directed to sites with inappropriate material will be treated as if the content were posted directly on our platform. Such actions will result in moderation measures, up to and including termination of account, in accordance with our posting policies.

12. Prohibited Activities

Access to and use of AgTutors is intended for lawful, personal, and non-commercial purposes only. We strictly prohibit the following activities:

  • Unauthorized Collection: Directly or indirectly compiling data or content from the site into a database or directory without explicit written consent from AgTutors is not allowed.
  • Misuse of Site Resources: The creation of user accounts through automated means or under false pretenses, the use of the site for unsolicited email dissemination, or employing buying agents for purchases are prohibited.
  • Security Breaches: Interfering with the site’s security measures, including circumventing access restrictions or copying content, is strictly forbidden.
  • Fraudulent Activities: Engaging in activities that deceive, defraud, or mislead AgTutors and its users, including phishing for account information, is unacceptable.
  • Abuse of Services: Misusing our support services, submitting false reports, or overburdening the site through automated means compromises the integrity of our community and is not permitted.
  • Interference and Disruption: Actions that disrupt the site’s operations or impose an unreasonable burden on its infrastructure, including the use of robots, data mining tools, or other automated systems, are prohibited.

  • Malicious Software: Introducing viruses, trojan horses, or engaging in spamming disrupts the experience of other users and is strictly prohibited.

  • Software Misuse: Unauthorized use of scripts, bots, or any software to access, scrape, or index the site, or any unauthorized software that interferes with the operation of the site, is not allowed.
  • Reputational Harm: Actions that disparage, tarnish, or harm the reputation of AgTutors or the site are against our community principles.
  • Legal Compliance: Users must comply with all applicable laws and regulations while using the site. Unauthorized use contrary to such laws is prohibited.

13. Data Use Limitation

The data and profiles provided on this site are intended solely for the purpose of connecting students and tutors.

14. Honor Code

Students and tutors agree to abide by the Texas A&M Honor Code.

15. Personal Information

All online communication between students and tutors shall be through this app.

1. Information Collected

When engaging with our site, as part of ordering, registering, or interacting in other ways, you may be prompted to enter your name, email address, credit card information, and other details to enhance your experience.

2. Information Collection Timing

Information is gathered from you when you register, place an order, fill out a form, use our site, or enter information on our site.

3. Use of Information

The information we collect may be used in the following ways:

8. California Online Privacy Protection Act (CalOPPA)

CalOPPA requires any person or company in the United States (and conceivably the world) that operates websites collecting Personally Identifiable Information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with
